Surf Camp Australia

Declaration, Release, Indemnity

The Customer

The person whose name and other particulars appears below hereby applies to participate in a surf camp conducted by Surf Camp Australia Pty Limited (“Surf Camp”) on the dates shown below (in this document that person is described as “the Customer”).

Risk Acknowledgement

The Customer acknowledges that there are inherent dangers both apparent and hidden associated with surfing and associated surf camps. The Customer’s participation in the surf camp and surfing and other associated activities may involve injury.

Loss, Damage Or Injury

To the full extent permitted by law, Surf Camp excludes all liability for any loss, damage or injury to the Customer arising from or connected with any activity conducted by Surf Camp.

In particular, Surf Camp is not responsible for any loss or damage to a Customer arising from or relating to:

  • the Customer’s failure or refusal to obey an instruction from an instructor of Surf Camp; or
  • any medical, psychological or physical condition of the Customer at the date of this contract.

To the extent permitted under the Competition and Consumer Act 2010 (Cth), Surf Camp excludes liability for death or personal injury arising from the supply of recreational services. Nothing in this clause excludes, restricts or modifies any rights the Customer may have under Australian Consumer Law.

Physical Conditions

The Customer acknowledges and agrees that Surf Camp has no control in respect of weather, surf or other physical conditions during any surf camp. Surf Camp is accordingly not liable for any loss, damage, inconvenience to any Customer or any property of any Customer arising from all or any of these factors, except as required under Australian Consumer Law.

Customer Property

Each Customer is solely responsible and liable for safekeeping of all the property of the Customer. Surf Camp has no responsibility for any loss through theft, breakage or otherwise of any property of any Customer.

Termination, Lessons, Surf Conditions

Surf Camp reserves the sole and exclusive right to decide whether beach conditions, weather or other factors make any particular activity on a surf camp unsafe or inadvisable.

In such circumstances, Surf Camp may modify, postpone or reschedule any lesson or activity to a different time within the booked trip where possible.

Intermediate lessons, including paddling out beyond the broken waves, are subject to suitable surf, weather and safety conditions and may not always be possible.

Where conditions do not allow for paddling out beyond the broken waves, but the lesson otherwise proceeds, no replacement lesson or credit will be scheduled for that reason alone.

If a lesson or activity cannot be rescheduled within the booked trip, a rescheduled lesson or credit for the missed surf lesson will be offered. No refund will be given unless required under Australian Consumer Law.

Refusal

Surf Camp reserves the sole and exclusive right at its absolute discretion to refuse any person, including any Customer, for any reason to participate in any surf camp or any part of any surf camp whether that person has previously paid for a surf camp or not.

Equipment

Where Surf Camp supplies equipment to any Customer, Surf Camp will use its best endeavours to ensure that adequate and suitable equipment is made available.

As a Surfing Australia licensed surf school, Surf Camp exclusively uses custom foam surfboards for lessons, with a range of sizes available. Surfing Australia licensed surf schools are not permitted to use hardboards as part of customer lessons for safety reasons.

All equipment is used at the Customer’s own risk. The Customer will pay for all damage to equipment provided by Surf Camp caused by misuse or negligence.

Nothing in this clause excludes, restricts or modifies any rights the Customer may have under Australian Consumer Law.

Directions & Instructions

The Customer must obey all directions and instructions from Surf Camp’s staff and must not disturb other participants in any surf camp or interfere with the surf camps instructors’ ability to conduct the surf camp in a safe and secure manner.

Property

No Customer must damage, deface or remove any object from any beach or any of the equipment being used in any surf camp.

Removal

Surf Camp reserves the absolute right at its discretion to remove from any surf camp any Customer who does not comply with these terms, without refund unless required under Australian Consumer Law.

Inspections

Surf Camp reserves the right to inspect any bag or other container brought to any Surf Camp by any Customer.

Drugs & Alcohol

No Customer is permitted to bring any drug or alcohol to any surf camp without the express prior written permission of Surf Camp.

Basic Requirements

The basic requirements for all Customers are that they must:

  • be able to swim;
  • be 18 years of age or over;
  • be of sound mind; and
  • be in good health.

Surf Camp reserves the absolute right at its sole discretion to require any Customer to undergo any test to assess whether the Customer is capable of participating in the surf camp.

Medical Conditions

The Customer declares that they have disclosed any medical condition which may prevent the Customer undertaking the surf camp, including but not limited to acrophobia, epilepsy, dizziness, limb or back injury, angina or other heart condition, severe or uncontrolled asthma, visual impairment, depression or recovering from recent surgery.

At Own Risk

Each Customer participates in each surf camp at his or her own risk.

Breath Test

No Customer will be permitted to participate in a surf camp at any time if their blood alcohol concentration is 0.05% or greater or if they are under the influence of any drugs legal or otherwise. Surf Camp reserves the right to perform a breath test on every Customer and should a Customer refuse to be breath tested then Surf Camp reserves the absolute right at its sole discretion to refuse that Customer permission to participate in any surf camp, without refund.

Personal Information

All personal information including name, contact number & email address is used solely for the purpose of the booking at Surf Camp Australia and will not be disclosed to anyone outside of Surf Camp Australia.

Bookings, Cancellations & Payments

Cancellations & Changes

Surf Camp Australia Pty Ltd (SCA) reserves the right to cancel any trip, in which case a reschedule or refund will be provided in accordance with Australian Consumer Law.

Any change of date more than 7 days prior to trip commencement will incur a $100 administration fee per person.

Any change within 7 days prior to trip commencement is treated as a cancellation.

Non-attendance or cancellations less than 7 days prior to trip commencement will result in a 100% fee (no refund).

Discounted bookings (including but not limited to promotional codes, specials and earlybird offers) are non-refundable.

Tickets are non-transferable.

Open Dated Tickets are valid for 12 months.

All cancellations are subject to the fees outlined below.

Prices are subject to change without notice.

Cancellation Fees

  • Within 7 days prior to trip commencement: 100% fee (no refund)
  • More than 7 days prior to trip commencement: $100 cancellation fee per person
  • Discounted bookings at any time: 100% fee (no refund)

Nothing in this clause excludes or limits any rights under Australian Consumer Law.

Currency

All prices and transactions are in Australian Dollars (AUD).
